Steps of the EB-3 Green Card Program
The EB-3 (Employment-Based Third Preference) Green Card allows foreign workers to become lawful permanent residents of the U.S. through employer sponsorship.

Step 1: Job Offer from a U.S. Employer
The process begins with a valid full-time job offer from a U.S. employer. The position must be:

  • Permanent (not seasonal or temporary)
  • For a role where there is a shortage of willing and qualified U.S. workers
Categories Covered Under EB-3:
  • Professionals
  • Skilled Workers
  • Unskilled Workers
Step 2: PERM Labor Certification
The employer must file for PERM (Program Electronic Review Management) Labor Certification with the U.S. Department of Labor (DOL) to prove:
  • There are no qualified U.S. workers available for the job
  • Hiring a foreign worker won’t negatively affect U.S. wages or working conditions
This involves:
  • Job advertisement & recruitment
  • Salary verification (prevailing wage determination)
  • Filing ETA Form
Step 3: Filing Form I-140 (Immigrant Petition for Alien Worker)
Once the PERM is approved, the employer files Form I-140 with U.S. Citizenship and Immigration Services (USCIS). This petition shows:
  • The employer can afford to pay the offered wage
  • The employee meets all job qualifications
Optional: Premium Processing is available for faster results (15 calendar days).

Step 4: Wait for Priority Date to Become Current
Every EB-3 petition gets a priority date (the date the PERM was filed). You must wait for your priority date to become “current” based on the Visa Bulletin released monthly by the U.S. Department of State.

Step 5: Undergo Consular Processing and file Form DS-260 at a U.S. embassy or consulate.

Step 6: Receiving a U.S. Permanent Resident Card (Green Card).

The B1/B2 Visa is a non-immigrant visa that allows foreign nationals to temporarily visit the United States for business (B1) or tourism (B2) purposes. Applicants will receive this visa for both purposes, used for multiple entries, typically for 5 years.
